Some ahādīth (7) in refutation of the killing by the khawārij (terrorists)

صحيح البخاري كِتَابٌ : الْمَغَازِي. بَابٌ : حَجَّةُ الْوَدَاعِ.

أَلَا إِنَّ اللَّهَ حَرَّمَ عَلَيْكُمْ دِمَاءَكُمْ وَأَمْوَالَكُمْ كَحُرْمَةِ يَوْمِكُمْ هَذَا فِي بَلَدِكُمْ هَذَا فِي شَهْرِكُمْ هَذَا، أَلَا هَلْ بَلَّغْتُ ؟ “. قَالُوا : نَعَمْ. قَالَ : ” اللَّهُمَّ اشْهَدْ ” ثَلَاثًا.

64 Military Expeditions led by the Prophet (pbuh) (Al-Maghaazi)
(77) Chapter: Hajjat-ul-Wada
No doubt,! Allah has made your blood and your properties sacred to one another like the sanctity of this day of yours, in this town of yours, in this month of yours.” The Prophet (ﷺ) added: No doubt! Haven’t I conveyed Allah’s Message to you? ” They replied, “Yes,” The Prophet (ﷺ) said thrice, “O Allah! Be witness for it.” The Prophet (ﷺ) added, “Woe to you!” (or said), “May Allah be merciful to you! Do not become infidels after me (i.e. my death) by cutting the necks (throats) of one another.”

Sahih al-Bukhari 4403

صحيح البخاري – كِتَابُ الدِّيَاتِ – قَوْلُ اللَّهِ تَعَالَى : وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ. 6862 (المجلد : 9 الصفحة : 2)

حَدَّثَنَا عَلِيٌّ ، حَدَّثَنَا إِسْحَاقُ بْنُ سَعِيدِ بْنِ عَمْرِو بْنِ سَعِيدِ بْنِ الْعَاصِ ، عَنْ أَبِيهِ ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ” لَنْ يَزَالَ الْمُؤْمِنُ فِي فُسْحَةٍ مِنْ دِينِهِ مَا لَمْ يُصِبْ دَمًا حَرَامًا “. مسند أحمد ( 5681 ) 

87 Blood Money (Ad-Diyat)
(1) Chapter: “… And whoever kills a believer intentionally, his recompense is Hell …”

Narrated Ibn `Umar:

Allah’s Messenger (ﷺ) said, “A faithful believer remains at liberty regarding his religion unless he kills somebody unlawfully.”

Sahih al-Bukhari 6862

صحيح البخاري – كِتَابُ الْفِتَنِ – بَابُ قَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : ” مَنْ حَمَلَ عَلَيْنَا السِّلَاحَ “. 7072 (المجلد : 9 الصفحة : 49)

حَدَّثَنَا مُحَمَّدٌ ، أَخْبَرَنَا عَبْدُ الرَّزَّاقِ ، عَنْ مَعْمَرٍ ، عَنْ هَمَّامٍ ، سَمِعْتُ أَبَا هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : ” لَا يُشِيرُ أَحَدُكُمْ عَلَى أَخِيهِ بِالسِّلَاحِ ؛ فَإِنَّهُ لَا يَدْرِي لَعَلَّ الشَّيْطَانَ يَنْزِعُ فِي يَدِهِ ، فَيَقَعُ فِي حُفْرَةٍ مِنَ النَّارِ “. صحيح مسلم ( 2617 ) مسند أحمد ( 8212 ) 

92 Afflictions and the End of the World
(7) Chapter: “Whosoever takes up arms against us, is not from us.”

Narrated Abu Huraira:

The Prophet (ﷺ) said, “None of you should point out towards his Muslim brother with a weapon, for he does not know, Satan may tempt him to hit him and thus he would fall into a pit of fire (Hell)”

Sahih al-Bukhari 7072

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ ، قَالَ : حَدَّثَنَا عَبْدُ الْوَاحِدِ ، قَالَ : حَدَّثَنَا أَبُو بُرْدَةَ بْنُ عَبْدِ اللَّهِ ، قَالَ : سَمِعْتُ أَبَا بُرْدَةَ ، عَنْ أَبِيهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ : مَنْ مَرَّ فِي شَيْءٍ مِنْ مَسَاجِدِنَا، أَوْ أَسْوَاقِنَا بِنَبْلٍ فَلْيَأْخُذْ عَلَى نِصَالِهَا، لَا يَعْقِرْ بِكَفِّهِ مُسْلِمًا. صحيح البخاري ( 7075 ) صحيح مسلم ( 2615 ) سنن أبي داود ( 2587 ) سنن ابن ماجه ( 3778 ) مسند أحمد ( 19488, 19500, 19545, 19577, 19674, 19703, 19754 )

8 Prayers (Salat)
(67) Chapter: Passing through the mosque (is permissible)

Narrated Abu Burda bin `Abdullah:

(on the authority of his father) The Prophet (ﷺ) said, “Whoever passes through our mosques or markets with arrows should hold them by their heads lest he should injure a Muslim.”

Sahih al-Bukhari 452


صحيح البخاري – كِتَابٌ : الْجِزْيَةُ – بَابُ إِثْمِ الْغَادِرِ لِلْبَرِّ وَالْفَاجِرِ. 3189 (المجلد : 4 الصفحة : 104)

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا جَرِيرٌ ، عَنْ مَنْصُورٍ ، عَنْ مُجَاهِدٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ فَتْحِ مَكَّةَ : ” لَا هِجْرَةَ، وَلَكِنْ جِهَادٌ وَنِيَّةٌ، وَإِذَا اسْتُنْفِرْتُمْ فَانْفِرُوا “. وَقَالَ يَوْمَ فَتْحِ مَكَّةَ : ” إِنَّ هَذَا الْبَلَدَ حَرَّمَهُ اللَّهُ يَوْمَ خَلَقَ السَّمَاوَاتِ وَالْأَرْضَ، فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ، وَإِنَّهُ لَمْ يَحِلَّ الْقِتَالُ فِيهِ لِأَحَدٍ قَبْلِي، وَلَمْ يَحِلَّ لِي إِلَّا سَاعَةً مِنْ نَهَارٍ، فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ، لَا يُعْضَدُ شَوْكُهُ، وَلَا يُنَفَّرُ صَيْدُهُ، وَلَا يَلْتَقِطُ لُقَطَتَهُ إِلَّا مَنْ عَرَّفَهَا، وَلَا يُخْتَلَى خَلَاهُ “. فَقَالَ الْعَبَّاسُ : يَا رَسُولَ اللَّهِ، إِلَّا الْإِذْخِرَ ؛ فَإِنَّهُ لِقَيْنِهِمْ وَلِبُيُوتِهِمْ. قَالَ : ” إِلَّا الْإِذْخِرَ “. صحيح البخاري ( 1349, 1587, 1833, 1834, 2090, 2433, 2783, 2825, 3077, 4313 ) صحيح مسلم ( 1353 ) سنن أبي داود ( 2017, 2480 ) سنن الترمذي ( 1590 ) سنن النسائي ( 2874, 2875, 2892, 4170 ) سنن ابن ماجه ( 2773 ) سنن الدارمي ( 2554 ) مسند أحمد ( 1991, 2279, 2353, 2396, 2896, 2962, 3253, 3335 ) 

58 Jizyah and Mawaada’ah
(22) Chapter: The sin of a betrayer

Narrated Ibn `Abbas:

Allah’s Messenger (ﷺ) said on the day of the conquest of Mecca, “There is no migration now, but there is Jihad (i.e.. holy battle) and good intentions. And when you are called for Jihad, you should come out at once” Allah’s Messenger (ﷺ) also said, on the day of the conquest of Mecca, “Allah has made this town a sanctuary since the day He created the Heavens and the Earth. So, it is a sanctuary by Allah’s Decree till the Day of Resurrection. Fighting in it was not legal for anyone before me, and it was made legal for me only for an hour by daytime. So, it (i.e. Mecca) is a sanctuary by Allah’s Decree till the Day of Resurrection. Its thorny bushes should not be cut, and its game should not be chased, its fallen property (i.e. Luqata) should not be picked up except by one who will announce it publicly; and its grass should not be uprooted,” On that Al-`Abbas said, “O Allah’s Messenger (ﷺ)! Except the Idhkhir, because it is used by the goldsmiths and by the people for their houses.” On that the Prophet (ﷺ) said, “Except the Idhkhir.”

Sahih al-Bukhari 3189

صحيح البخاري – كِتَابٌ : الْجِزْيَةُ – بَابُ إِثْمِ مَنْ قَتَلَ مُعَاهَدًا بِغَيْرِ جُرْمٍ. 3166 (المجلد : 4 الصفحة : 99)

حَدَّثَنَا قَيْسُ بْنُ حَفْصٍ ، حَدَّثَنَا عَبْدُ الْوَاحِدِ ، حَدَّثَنَا الْحَسَنُ بْنُ عَمْرٍو ، حَدَّثَنَا مُجَاهِدٌ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو رَضِيَ اللَّهُ عَنْهُمَا، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : ” مَنْ قَتَلَ مُعَاهَدًا لَمْ يَرِحْ رَائِحَةَ الْجَنَّةِ، وَإِنَّ رِيحَهَا تُوجَدُ مِنْ مَسِيرَةِ أَرْبَعِينَ عَامًا “. صحيح البخاري ( 6914 ) سنن النسائي ( 4750 ) سنن ابن ماجه ( 2686 ) مسند أحمد ( 6745 )

(5) Chapter: The sin of one who kills an innocent person having a treaty with the Muslims

Narrated `Abdullah bin `Amr:

The Prophet (ﷺ) said, “Whoever killed a person having a treaty with the Muslims, shall not smell the smell of Paradise though its smell is perceived from a distance of forty years.”

Sahih al-Bukhari 3166

Concluding with a verse from the Qur-ān:

وَلَا تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ ۗ وَمَن قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِف فِّي الْقَتْلِ ۖ إِنَّهُ كَانَ مَنصُورًا

الإسراء : 33 

And do not kill anyone whose killing Allâh has forbidden, except for a just cause. And whoever is killed wrongfully (Mathlûman intentionally with hostility and oppression and not by mistake), We have given his heir the authority [to demand Qisâs, – Law of Equality in punishment – or to forgive, or to take Diyah (blood money)]. But let him not exceed limits in the matter of taking life (i.e he should not kill except the killer). Verily, he is helped (by the Islâmic law). Qur-ān [17:33]
